1. Overview and Acceptance of Terms

Fireside WiFi, LLC ("Fireside WiFi," "we," "our," or "us") provides wireless internet access ("Service") at select remote outdoor locations, including but not limited to campgrounds, trailheads, and recreational areas. These Terms of Service ("Terms") govern your use of the Service.

By accessing the Fireside WiFi network through the captive portal login page, you agree to comply with and be bound by these Terms. Fireside WiFi reserves the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of any updated Terms.

2. Eligibility

The Service is intended for users aged 18 and older. Users under 18 must have parental or guardian consent and supervision while using the Service. By connecting, you represent that you are at least 18 years of age or that you have obtained parental or guardian consent.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree NOT to use the Fireside WiFi network to:

Fireside WiFi reserves the right to immediately suspend or terminate your access to the Service without notice if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.

You acknowledge that the Fireside WiFi network is a shared, public wireless network. You understand and agree that:

When you connect to the Fireside WiFi network, we may collect the following information:

We do not monitor, log, or record the content of your internet activity, including websites visited, searches performed, or files transmitted, except as may be required by law.

We may share collected data with law enforcement if required by law, subpoena, or court order. We will not sell your personal information to third parties.

6. Content Filtering

Fireside WiFi may implement DNS-level content filtering to block access to categories of websites known to host illegal content, malware, or other harmful material. Content filtering is provided on a best-effort basis and is not guaranteed to block all inappropriate or illegal content. You remain solely responsible for the content you access through the network.

7. Service Availability and Quality

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIRESIDE WIFI, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

You acknowledge that Fireside WiFi acts solely as a conduit for internet access and does not control, monitor, or endorse any content accessed through the Service. Fireside WiFi is not responsible for any content created, transmitted, or displayed by users of the network.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fireside WiFi, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

10. Intellectual Property

Fireside WiFi does not authorize, encourage, or condone the infringement of any intellectual property rights through the use of our network. In accordance with the Digital Millennium Copyright Act (DMCA), Fireside WiFi will respond to valid notices of copyright infringement and may terminate access for repeat infringers.

11. Third-Party Services and Links

The Service may provide access to third-party websites, applications, and services. Fireside WiFi does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in Salt Lake City, Utah, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fireside WiFi regarding your use of the Service and supersede all prior or contemporaneous communications, proposals, and representations with respect to the Service.
